The Power of Civil Contempt
Each party to a divorce order or other family law court order must obey the terms of the order. Your ex-spouse or the parent of your child does not have a legal right to choose not to pay their child support or violate the terms of a custody and visitation order. If they are in violation of a court order, we can work to make them comply with the terms of the order. When necessary, we can file a motion to a court of competent jurisdiction to hold your ex-spouse in contempt of court.
The penalties for civil contempt of court are significant. In addition to being ordered to comply with the divorce decree, support order or other order of the court, a person found in contempt of court may be ordered to pay court costs and attorney's fees. In extreme cases, a court even has the right to send a person to jail for contempt of court.
